By purchasing our membership plans, scheduling clinical consultation services, or using our website, you ("Client," "Member," or "you") agree to these Terms of Service. Please read them carefully before purchasing or using our services.

1. Scope of Services

 

WellCooRx Health provides pharmacist-led healthcare navigation, medication management support, care coordination, medication education, and patient advocacy services.

 

No Medical Diagnosis or Prescribing

 

Our pharmacists do NOT:

• diagnose medical conditions;

• prescribe medications;

• independently modify or discontinue medications; or

• replace the medical judgment of your physician or other licensed healthcare provider.

 

All clinical recommendations are educational and intended to support informed discussions with your healthcare providers.

 

Not a Pharmacy

WellCooRx Health is NOT a pharmacy and does NOT dispense, manufacture, distribute, or ship prescription medications.

 

Not Emergency Medical Care

 

Our services are NOT intended for medical emergencies.

 

If you experience a medical emergency, CALL 911 immediately or GO to the nearest emergency department.

 

Always consult your prescribing healthcare provider before making any changes to your medications.

 

2. Authorization to Coordinate Care

 

By enrolling in a package or purchasing our services, you authorize WellCooRx Health to communicate with your physicians, healthcare providers, pharmacies, health insurance plans, and other authorized healthcare entities as reasonably necessary to provide the services you request.

This authorization may include activities such as:

• coordinating prescription refills;

• requesting prescription renewals;

• facilitating prior authorization requests;

• verifying prescription information;

• obtaining medication-related information; and

• assisting with continuity of care.

 

This authorization remains in effect until revoked in writing by you or until your services are terminated.

 

3. Billing

 

Automatic Renewal

 

Medication Refill Concierge Memberships are recurring subscriptions billed automatically every thirty (30) days using your payment method on file unless canceled.

4. Cancellation & Refund

 

Medication Refill Concierge Packages

​

• Memberships may be canceled at any time.

• Written notice is required by email or text message.

• Refund requests will be processed within three (3) business days. The time for funds to appear in your account depends on your financial institution.

• A $50 administrative processing fee applies to approved membership refunds.

• Services already rendered are non-refundable.

• Annual memberships are refunded on a prorated basis based on services already provided.

 

Professional Clinical Services

(Medication Review - CMR, Medication Reconciliation, Healthcare Navigation)

• Appointments may be canceled at least 24 hours before the scheduled appointment time.

• If canceled at least 24 hours in advance, the patient may choose one of the following options:

  • Reschedule the appointment one (1) time at no additional charge, subject to the pharmacist's availability; or

  • Request a refund, less a $50 administrative processing fee.

• Cancellations made less than 24 hours before the appointment, missed appointments (no-shows), or failure to attend without notice may be charged the full service fee and may not be eligible for a refund.

• Additional rescheduling requests beyond the one complimentary reschedule may be subject to a rescheduling fee.

Gift Cards

• Non-refundable after purchase.

 

WellCooRx Commitment

We understand that unexpected situations can occur. If you experience an emergency or extenuating circumstances, please contact us as soon as possible. We will review requests on a case-by-case basis and strive to provide reasonable accommodations whenever possible.

 

5. Payment Processing

 

Payments are processed securely through our third-party payment processor.

 

By submitting payment information, you authorize WellCooRx Health to charge your selected payment method for applicable services and recurring membership fees.

 

6. Chargebacks

 

If you believe a billing error has occurred, please contact us before initiating a chargeback with your financial institution.

 

Unauthorized or fraudulent chargebacks may result in suspension or termination of services while the matter is investigated.

 

To the extent permitted by applicable law, WellCooRx Health reserves the right to recover reasonable costs associated with fraudulent or bad-faith chargebacks.

 

7. Gift Cards and Discounts

• may be redeemed only toward eligible WellCooRx Health services;

• are non-refundable;

• are not redeemable for cash except where required by law;

• may not be resold or transferred unless expressly permitted; and

• expire only if permitted by applicable law and stated at the time of issuance.

 

Any remaining balance will remain available as account credit for future eligible purchases.

 

8. Privacy

 

Your use of our services is also governed by our Privacy Policy and HIPAA Notice of Privacy Practices, where applicable.

 

By using our services, you acknowledge that you have reviewed these documents.

 

9. Limitation of Liability

 

To the fullest extent permitted by law, WellCooRx Health shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

 

Our total liability for any claim shall NOT exceed the amount you paid for the specific service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

 

10. No Guarantee of Outcomes

 

While we strive to provide accurate information and timely care coordination, we CANNOT guarantee:

• medication approval by insurance companies;

• prescription renewal approval by doctor's office;

• prescription availability;

• physician response times;

• successful prior authorization outcomes;

• medication cost savings; or

• specific clinical outcomes.

 

11. Governing Law

 

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

 

Any disputes shall be resolved in the appropriate state or federal courts located in Texas unless otherwise required by applicable law.

 

12. Changes to These Terms

 

We may update these Terms of Service periodically.

 

Updated versions become effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
